How to claim compensation for delayed flight.

"Good morning to all and particularly to my fellow travellers on the ill fated MT430 flight from Gatwick to Antalya on the 6th of Jan.

Just a heads up. The letters given out at Antalya airport by the Thomas cook rep appears to suggest that you can only claim compensation if you had travel insurance. This is not the case - EU Regulations allow for compensation to be paid to passengers experiencing long delays and you can apply for this via this email address: customer.relations@thomascook.onmats.com

There is an actual claim form that can be found (eventually) on the Thomas Cook website, but after over an hour of unsuccessfully trying to fill in the form, spoke to someone on Live Chat who told me to email because the form was generally for UK customers (even though it has a drop down country box) It would appear that if you accept vouchers you can claim 400 GBP, but cash payments are 350 GBP.

You have 28 days to make this claim. You will need your booking confirmation number. Flight number and travel dates. I do know first hand of another fellow passenger who has successfully claimed and has been told to expect the money within the next few days.

Good luck and let's hope this is one of the hundreds of advantageous EU regulations retained when we eventually Brexit that people don't know about until they need them."

Thanks to my friend Lynda Yilmaz for the above information which I have just copied and pasted for the benefit of anyone that was on this flight. The flight stopped at Athens because of an overheating engine and I believe about ten hours later another plane arrived to take them on the final leg to Antalya.

I also have a friend that was waiting for this flight in Antalya, returning from a few days break here over the new year and has just been notified that £355 is winging its way to her bank account    :)

Good info for anyone affected Nicola. 10hrs wait must have been a nightmare!

Our friends said they were all taken to a room and locked in.
They had to be escorted to the toilets.
Everyone was  issued with a mc donalds voucher in euros but as they were through security and mc donalds wasnt they couldn't use it.
At least Athens let them in.
When my son got diverted to stanstead they had to stay on the plane as there were no ground staff until they took off again to Gatwick.

Well, I think anybody who claims for a delay is a dickhead. Have they no consideration for the crew who have suffered the same delay and get no recompense. Delays cost airlines a fortune before the claims come in and they do not create delays for whatever reason. At the end of the day there will be higher prices across the board!!!

I disagree. I think the fact that they have to compensate means they have to make more effort to depart on time etc and leads to better service.

This subject was covered last year in this thread. I still stand by my assertion that making potentially £200 profit out of this is wrong.

In the thread above I used my example of a Monarch flight costing £120 had it been delayed enough to be covered by these rules £receiving £350 although very nice would be wrong. A reasonable amount of compensation in those circumstances would be £150.

As Stoop said in the earlier thread, "it is the rules that are wrong, not the people for claiming". It is just an example of a rule dreamed up on the hoof and not thought through properly.

I think I would have to make my own ethical choice regarding a claim for compensation.

A three hour and one minute delay spent being "looked after properly" would not, to my mind warrant a claim.

Several hours of being ignored and trying to find somewhere to sit, having to pay airport prices for snacks and drinks etc. accompanied by poor information and ignorant staff almost certainly would. Particularly if thousands of pounds have been spent on tickets.

The amounts paid are not determined by the price of the flight. Several hundreds of pounds compensation for a £29.00 flight seems all wrong.

Budget airlines especially cannot support this "catch all" EU ruling.

Perhaps the compensation should be the amount paid for the ticket with a maximum amount payable.

Anyway, it's a EU ruling so after Brexit it may well all change for UK airlines.

In the meantime, if you feel it necessary, Nichola's post offers sound advice.

Kayakebab - that's one of the "claim all that I can" situations.

KKOB's standpoint I fully understand but in your case I'm sure (I stand to be corrected) he would seek some recompense.
