I've been coming round to the idea of a PoA for some time now, but what if the death of either spouse takes place in Turkey, how joined up is Turkish government in terms of death cert. or equivalent, is issued.  Then how quickly, if at all, are other government departments - in particular TAPU office, notified?  Or does it - the preferrred solution - rely on the spouse to present the death certificate to whichever government department.

Ask your spouse to die on holiday away from Turkey would be my advice  ;)

There's plenty of what ifs, but having PoAs for each other can only be helpful - just not so helpful if the death happens in Turkey.

Huge respect for Loz, very knowledgable and hugely informative for a 21 year old. Seriously though, impressive!   ;)

We did the POA in June.
We took a translator named Alper, a very nice guy, to the Notors office.
The cost was 545 tl for the Notor and  100 tl for the translator.
This was arranged for us by a very nice Turkish guy and it took 30 minutes
to complete. Thanks Nicola and Loz for the posts.

I believe this would only be of interest to persons owning properties in Turkey, ( the initial reason for this thread ), if the reciprocity which is supposed to exist between U.K. & Turkey, was in fact, put into place !! I would imagine that the many, many Turks who live in the U.K. will not be bound by the Inheritance Laws appertaining to their own country, regardless of how many relatives, legal or otherwise , that they have !!

The only way to get round the problem is to put the Tapu under the name or names of the people who you want to have it at the beginning or do it as a sale and pay 4% tax and fees later. You then can create a document stating that they can not do anything with the property whilst you still live in it or until your death.Much cheaper than state taxes plus the time facture as it could take years to settle claims.

Mac2010 great idea in theory, I did discuss this scenario previously, the problem would get complicated further if one of the other named persons on Tapu dies .
