That's a toughie to define clearly bob 1. Knives and guns may well constitute "aggravated" burglary but  an object has to be made or adapted and intended for use as a weapon.

The Theft Act is a funny one to get clear.

In theory, if someone walks into Morrison's with no money and a clear intent to steal I guess that could stretch to burglary. Never does though.

The old idea was burglary happens at night and housebreaking during the day.

Thankfully, the lowlife got his comeuppance and I am sure there will be a significant reduction in burglaries in the area as a result.

Different circumstances:
Tony Martin used an illegally held shotgun,and the person who died was shot in the back whilst trying to flee through a window.

He was also protecting his disabled wife upstairs in bed.. He must have been terrified what was going to happen to her when the other burglar went upstairs..

Yes, different circumstances but the principle is the same.

Anyway, the old boy has been bailed pending further investigations and hopefully no further action will be taken against him.

Cases like this are emotive and while folks say "great, the guy got what he deserved", its the old boy that has to live with the fact that he killed someone.  He's not a Police officer shooting a suspect, he's not a soldier shooting another soldier in war, he's a seventy eight year old man who was defending his wife and his property and ended up taking a life.

Sadly, no winners in this situation.

Bailed after spending 48hours in a police cell after his elderly dementia stricken wife was left confused and bewildered. This poor old fella has to live with the consequences of his actions and the knowledge he killed another person, and any backlash from that. Comes to summat when you aren't even safe in your own bed at night..feel for these people. Like you say there are no winners here.
