Title: Tui flight 17/7/18.

Hi all. My daughter flew from Dalaman to Manchester on 17/7/18, on flight Tom707. The flight was delayed, and when it eventually landed at Mcr airport, Tui said that the flight was only late by 2hours and 59 minutes. Was anyone on the forum on this flight? If so did they get any compensation? My daughter is thinking of taking the matter to CEDR. All answers appreciated.

Mary,
I see on my  flight  aware data history  for TOM 707 . 17/07/2018.

  should have left dalaman @ 23.50 hrs.
  but left  @  03.18 hrs .
== 3 .28 mins late leaving,
 should have arrived Manchester @ 0220 hrs.
 landed  @ Manchester @ 0521 hrs.
the fact it left dalaman 3.28 hrs late means £ 350 compensation each passenger. that was the actual delay.

 not the fact that it gained speed / flight time  during the flight.
 go on line to put in the valid claim

So you can definately claim even if the flight arrived 2 hours and 59 minutes late?

I thought the delay was to your arrival not departure.

I'm also pretty sure that compensation is only paid on arrival delays, not departures.

It’s based entirely on the time of doors opening on arrival.

On Blueclad's info it was 3 hours and 1 minute late.

I quoted the landing time at Manchester not when the doors opened at the gate,
flight aware data history  only gives landing time not knowing Manchester airport it must take a while to taxi to the gate and open the doors so it must have been over the 3 hr time limit

Unless they opened the doors during the descent.

I wouldn't put anything past Thomas Cook :D

Don't give them ideas. They'll chuck the passengers onto the runway to avoid paying out

We had a delay with TUI Manchester to Dalaman on the 28th May over four hours late .no refreshments offered . contacted them the next day on their claim form. received an automated response saying they would be in touch within 56 days. To date still no response despite several emails and phone calls which have all been ignored.
Now with CEDR .There are thousands of complaints about TUI not paying compensation they try every trick in the book .they hope that people will just give up trying to get in touch with them.
Scunner is correct it depends on the time they actually open the doors even if it means your still sitting on the plane. in our case the plane landed 4 hours late and was due to a technical fault so it is a straight forward claim but they are not interested. I've read that people have had to take them to court and won. TUI are horrendous. Good luck with your claim we are still waiting for a response.

The EU ruling 216/2004 is on Wikipedia.Perhaps that would be helpful to read.  :)
