Title: Maintenance Company Contracts
Post by: strange on February 15, 2019, 15:56:05 PM
I'd appreciate some advise here please.
We regularly sign a contract with our Management Company in May every year.
These Contracts are in English, but the T's & C's state it is eligible in Turkish law.
Is that correct, or for it to be eligible in Turkish law a version in Turkish needs to be signed & notarised?
Thanks

Does your site have an annual AGM?  Does it have a committee or just a random management company?

If you have a committee, AGM, use Turkish Condominium Law etc then yes, you need it to be minuted and notorised with a solicitor present at the meeting.
I am quite sure our paperwork is in both English and Turkish but have a feeling it is for ease of owners rather than a legality.

Our site ran perfectly for years without all of this and just a written agreement between our committee and management company.  Had we any problems though I am not so sure how well it would have held up in court.

Firstly, thanks Scunner for bumping my original post. I was beginning to feel unloved when there were no response.

Secondly, thanks Anna for your response. We aren't part of a Complex, just a stand-alone Villa, so no Committee. It's never been a problem with any of the Management Companies we've used, it's just we'll be renewing when we go out in May and the new Contract is signed, and something has been nagging at the back of my mind regarding this.
