What is a roof terrace?

I just read the other post about the pool screen requirement following a complaint and thought I would throw this in the mix

We have had to cover up our roof terrace following a complaint, we are in a duplex (3rd and 4th floor). The complainant is on the other side of the complex to us and the terrace faces away from the complex. Perhaps he complained therefore due to the complex committee taking him to court for lack of maintenance payments ;o)

Anyway, what denotes a roof terrace? Ours is on the same level as our bedrooms so is that a roof terrace or a balcony?

Lots of properties in the area have terraces now and I wondered if there was an agreed definition or if I could simply closedown everyones terrace by simply making a complaint about them.

I would not be "afraid to do within reason what I wanted to do", nor was I. I would also say that putting in a new pool to an existing and established property will be more likely to find such a neighbour than buying a property that already has a pool, or buying on a complex where all your neighbours like the pool because it's theirs too.

I wouldn't be scared, I'd do it to keep the peace locally. Then I'd put in a complaint about his roof terrace or something

i think its when its in the roof level thats the problem,
so could see down on people etc
and they do need planning permision,
if it has no planning then its ilegal
fines will be issued.

I am not expecting the law to make sense but if that was true then what a strange rule. So, I could have a balcony on the 3rd floor or a window on the 4th and look down on people...but a terrace, a no no

I would get professional advice from some one who actually deals with this sort of
thing.

The rules can vary depending where you are situated - a roof terrace could be allowed
if you are near the sea - but then you could be on tourism land and that's a whole new
different minefield.

Some houses are built with a roof terrace which is covered over until all the building
inspectors have been to say that the property complies with the original permissions.
Once the "living permission" is granted the temporary roof is removed and Hey Presto
- a roof terrace !

If your house has been inspected and all the fees paid, in theory that's the end of it.
(but some members will definitely have stories which will say otherwise)

I think the problem you will have is that there will be many dozens of different
opinions and even more stories (some will actually be based on fact !)

Get legal advice - it will be the only way to solve the problem for certain.

Looks like the conclusion is that they are fine ..... Unless a miserable git complains even though your roof terrace is at the other end of the complex facing the other way

Really annoying as adjoining complexs/villas have them
