I was led to believe that even the non payers were still entitled to the full use of the complex facilities including any maintenance around their property.
Are you stating that this is not the case Liz?

I was being a bit tongue in cheek Anne. It may actually be counter productive to not maintain around their properties, as it would give them a further excuse to not pay their dues

A few years ago, a now ex - UK owner told us that he may consider an ex-gratia payment to the site if we kept it looking sufficiently good, so that he would get a better price for his properties, as he had no intention of occupying them. He soon found different when it came to the sale / change of tapu  ;D

Just to give you all an update - Just got back from Calis and at the site AGM, I obtained formal agreement and subsequently got it written in the decision book that I could sign POA to the sites solicitor. The reason being is that the solicitor had told me that she couldn't act on my behalf without formal POA, for certain tasks eg: getting the bailiffs in for non paying maintenance.

So all sorted and formally done at the Notary.

I have to be careful having just met with Liz a couple of weeks ago for advice - a cake and coffee at the Eyna was all that changed hands as well as excellent advice :-)

Anyway I had heard that the threat of a debt being lodged against the Tapu usually frightened people into paying as if they wanted to sell at any time this would scare off a lot of potential buyers - who would think OMG is he into the bank as well???

Thanks for that info Liz...one of the owners on our complex is in the process of finalising his sale,  has cancelled his standing order for maintenance, isn't responding to emails etc. so we did wonder what we could do.
