Title: Gifting property
Post by: Fran on April 12, 2011, 09:42:57 AM
Can anyone help with this. A friend wants to give his property in Calis to his father, he has asked if he just needs to go to the notary to do this. From other answers on this forum I have said that I think he has to sell the property to his dad, who would then have to have military clearance and pay all the associated buyers fees. is this correct. If he can not gift the property can he sell it for a nominal amount, or would this be seen as tax evasion.
Thanks. :)

Not just buyers fees (property purchase tax) but sellers fees possibly too. You can't gift it as you can here in the UK and the value will be set by someone so you can't undervalue it anymore. The alternative to all this expense is for both to agree a legal contract in the UK and leave the ownership as is.
