New changes on Buying property process

Two new  regulations for tapu process  started on 4th of March.
if the seller or buyer is foreigner, then an authorized valuation office have to give a valuation document
and buying selling tax will be calculated by this valuation, %1.5 seller %1,5 buyer. Valuation is taking 1-2 days. Valuation costs 1500-2000 lira.
Valuation takes 2-3 days and valid for 3 months.
Before as you remeber tax is paid by the valuation document taken from council and this was the 1/3 of real selling price.

Second one  is  certified sworn translators.

Normal Process, ( before)

In deed transactions, you are signing the application document. We make an appointment on your behalf.

On the same day or the next day, we take you from your home to the Tapu registry office and complete the

sales process with a sworn translator from Mugla city courthouse within 2 hours.

We are investigating the legal status of the house before sale and informing you if there is a negative record

in public offices.( Municipality council tax, tax office, tapu office and planning office)

In these days there is a problem and we don’t know when this problem will be solved.

Government put in rule . For this reason, foreigners in the land registry office can not make

sales and purchases directly. The new law says sworn translator should swear at the high court in Izmir.

And unfortunately, there is no interpreter who sworn in Izmir High Court.

In order to solve this problem, a side way is applied. Seller giving us a power of attorney to buy the house on buyers names

and we do all the transactions, next day you get your title deed.

The buyer and seller granted by Turkish persons, so the Tapu Office do not want an interpreter. This is not a risk for you
because you are giving a power of attorney to put your buyer's name on tapu. selling to 3rd parties cant be done.

Hi Good news,
I have been to Tapu office and checked how the process is done after the certified office valuation, in first week of regulation they calculated tax by the certified office valuation but now they stopped doing that and they charge tax as before by the Council valuation.

They ask for valuation from authorized valuation office, but they calculate the tax from councils valuation document which is very low.

I asked why you ask for certified office valuation if will calculate tax by  councils valuation.

They replied they want to do the valuation map of the cities.

Certified valuation is something you have to do but will not written on Tapu and tax WILL NOT calculated regarding this.

And tax discount which will end on the 31st of March is extended. You buyer and seller tax is 1,5 each, as before
