Hi
Can anybody help me with regards to property tax I have been informed that tax is due 1 year after the tapu is issued is this correct or not ,also how much is the tax and when is it due for payment.

Hi Brian - see my posting on this topic... I think payments are due by end of May each year, we paid £120 in the first May after we bought our villa but have been advised that the property was undervalued and we owe £1,000!

i have been told if it is a new build you do not have to pay property tax for five years. can anyone help with this thanks

difference between property tax and council tax,
Brian the council tax either May or November depending on when you own the property (Tapu in Hand)
Jools that is the property tax. if your agent tells you one figure they are guessing, the property tax is stated by the tapu when you are in reciept, our friends got stung this way, the agent told them the tax would xxx and the tapu valuation came through they were requested to pay the amount stated officially and not that of the agents.

My understanding is that the law says that the new owner does not pay council tax until the year after the Tapu is issued. Dont know about a new build, never heard that one and to be honest I doubt it very much.
As we all know, not everything out here abides by the law. Whilst the new owner may not be liable, I do not believe that means the council tax does not have to be paid, and as it is very unlikely that any previous owner or the builder is going to pay it, that leaves?? You guessed it!!
Now I rent, so dont have to pay council tax, but there have been some very big numbers mentioned regards the cost of council tax, so as a guide just let me say that my Brother -in -law has a 5 bed detached villa in Calis, and has paid just 114YTL for his 2007 council tax, so be very careful if you are asked for silly money by anyone, council tax is cheap.
To be sure, take your tapu to the council tax office, by the side of Carrefore, same place you pay your water bill. They can tell you exactly have much council tax you owe.

For council tax purposes is usually based on either residential or holiday residences, the will be either 01.% or 0.2% remember also that if 2, 3 or 4 names appear on the Tapu then then the cost is not split between how many are named but each person will pay as an individual.
If you receive you Tapu in September for example, you will be expected to pay your council tax by the following May if you have your Tapu in January then expect to pay in May Also.
Property Tax, paid at the time of purchase, if purchased prior to January 2007 then the 4 year rule applies regarding the Tax on the sale of a property before the and upto the 4 year limit. Tapu received after January 1st 2007 this has been increased to 5 years.
Properties will be re-assessed after the time limit reached.

My understanding is that the new Owner IS Liable for any unpaid bills/debts due on a property purchase. There are details about this on the Turkish Embassy Website, they urge all buyers to draft a 'Hand-over' document in English & Turkish, the Seller signs this & legally takes responsibility for any outstanding debts on the property.

your contract should be in both languages, and like purchasing in UK or anywhere else, the property should be checked for debts or charges against properties etc..
we purchased our property near 4 years ago and prices are extremely different to now, our council tax is approx 45TL (23TL each). I think it is up for re-assessment next year so could be interesting.

Couldn't agree more Loz :) The 'Hand-over' document the Turkish Embassy advises is supplementary to any 'Contract' between the parties. Checks for Debts/charges Should be made, unfortunately this is not always the case, even when 'professional' services have been paid for....
