I ve read various discussions on here about the road tax being imposed on home owners but cannot find if anyone ever established the legal position although a few said they were going to solicitors etc.I am in the UK but have just checked with the Belidye who say that my bill is 1000ytl for roads and 156 for council tax basically payable now although we are not out until May.There a re 4 villas on our little complex and when I advised the other owners to check theirs they said they were not paying because a friend had said it is not legally enforceable.i was wondering if we had a more definitive answer than "a friend"

their friend is talking a load of rubbish.
do you think anyone would pay it if it wasnt enforceable_.

Have spoken to one of our neighbours who went to the office with their English speaking solicitor who argued their case and their bill was written off,the solicitors explanation was its not legally enforceable.The 4 villas at our place are exactly the same and 4 different prices have been quoted,strangely enough 1 out of 4 do not have to pay,the Turkish family who live there all year round.

I am not sure if I am understanding this correctly. The way I am reading it is that the tax is not payable by anyone whether they live here or not for the whole or part of the year. If this is the case then what the local authority is doing is fraud.

Gerry ,all my Turkish neighbours have paid ,new roads are built ,everyone pays ,no fraud.

Same here; all our Turkish friends have paid. It's worth remembering that the property owners are responsible for payment so if the families mentioned are renting then they are not liable for the payment the landlord is.

Here is a reply from a Fethiye Solicitor;
This road tax is illegal as a tax, but the council can ask this money like duty or any other name.. The point is, they ask this money for the roads and the job to make a new road is theirs already. They are getting council tax for it, and any other tax and duty you are paying.
so, if you like we can take this issue to the court when they send you a letter asking the money to be paid. The court will decide whether you have to pay or how much you have to pay. (most likely the court will favour you)
However to go to court you need a lawyer, to prepare the documents for you and to act on behalf of you, and the legal fee will be more than the tax, and you can not recover this legal fee even if you win the case.
What happens if you do not pay? They say you pay now you only pay 3/4 of it, and to pay this road tax you have have 2 years, you can pay in instalments. If you do not pay, it will wait, however when you go there to pay the council tax, they will ask you about road tax as well. So, you can just leave it and if they do not abolish this road tax you can pay whenever you like + some interest on it. Please note that, when you sell the property you will have to pay all the tax because they do not give you the necessary paper if you do not pay all the tax owed to the council.

I have just been reading in Voices news sheet about a couple of guys (Brits) who have not paid their site fees and cannot be contacted via the contact numbers they left. They are about to loose their properties so the monies can be recovered. Could this happen if you refuse to pay the "road" tax?

There must be a method to working out who pays what. Is it depending on the value on your tapu or per sq metre perhaps?? It seems the norm times the number of names on the tapu.

It seems a righgt mess, see this extract from the email sent by my agent after I had paid £417 this year
"The biggest problem is that people find out neighbours a few meters away have paid vastly different amounts. We met some friends in Fethiye last week and they were saying that they both paid different amounts despite being 10 meters from each other. Contrary to popular belief it's not always the foreigners that pay more as in this case the Turkish neighbour paid more than the British couple"

Apparently you only pay if your Tapu was completed prior to April 2008 and the amount is worked out dependant upon the value stated on Tapu then by the number of names on the tapu.Hence we have 4 identical houses bought at 4 different times on the same complex with 4 different road tax bills.My neighbours Tapu value is the same as mine but because hers has one name on her bill is 500ytl as mine has 2 names on mine is 1000ytl !

As far as I was told, it was a formula based on the area and value declared on the tapu. This would make just about everybodies different value, especially if you bought many years ago and have a low declared value on the tapu.

Is the tax also payable for properties in Ovacik does anyone know?
Our property is on an unadopted road so I wont be impressed with a bill if I can't see anything for it.

Steve A, have you checked that about the double payment for 2 names or is it just hearsay again. We have paid ours, 2 names on the tapu and cost is split between the 2 of us.

I went to pay a freinds, two names on the Tapu so the cost was split between 2 less the discount for early payment. Nearly everyone on the complex has different amounts to pay, depending when they purchased and what value was put on the Tapu at the time of purchase.

Since the tax is for road work carried out in 2008 you should be OK then ;)

The tax is not specifically for the road that goes past you place it is the owner contributing to all of the improvements in the area.

Right have been back onto lawyer to clarify Tapu issue.The tax is a percentage of the value of your property declared on your tapu hence similar properties having different bills.The number of names on the Tapu does not matter this was misunderstanding.Her advice is to check what others with identical properties are paying then offer the lowest figure to the council which they usually take.

Are the council preparing letter for every house, do you wait to get your letter & then pay?
If owners have paid can they post here what they paid & for how many bedrooms. We can at least see the range even though we know the criteria is on the value on the tapu.
Maybe we can get an idea of what is being asked - but let's not deal with hearsay but in facts.

We wont be in Turkey until June. Is there a penalty for late payment. We don't see any post, it goes directly to our agent, so if some of our neighbours don't access this web site, they would be happily oblivious to all of this. :o

No they will not send any letters out. You will only find out if you go into the office and see them. Yes there is a penalty for late / non payment too.

We paid just over 800TL after the discount (3 bed). We also paid on behalf of others on the same complex and it's varied between 500TL-1100TL (3 and 4 bed).
We cannot see any logic to the calculations. Some owners, whose tapu values were more than ours, some the same size, some bigger, paid less than us.
Don't think the size of your property matters anyway. We've given up asking about it as we get a different response each time we go in!

We went in and asked, then decided to get it out of the way and just pay. We've also been in and paid on behalf of quite a number of other owners on our complex. That's why we're saying there doesn't appear to be any logic!

is this a Calis/fethiye thing because my road is half way down the valley after all the rain we have had lately,i will have to bring it back up and glue it back in place.

Andy and I went into the office and we paid 808 lira each we asked if this was a one off payment and the lad just srugged his shoulders and said it could be and then again they could ask again in a few years so who knows.Our place is on Lapis and is a 3 bedroom duplex and we are 2 names on the Tapu but we were told that it was calculated by the price quoted on your Tapu.

we went to pay our council tax and got asked to pay the road tax ,we wanted an explainnation on how the price was calculated and told by them that it depended on the price on your tapu
we were asked to pay 9OOytl but got the discount of 25%

Zabita came to our complex a couple of weeks back handing out the road tax bills for owners.

We paid ours and we did ask about it, why etc. we were told that if you have a tapu you have to pay. Even if there's 20 apartments on a complex, each owner has to pay. We could haver chosen not to pay, but we'd have lost the 1/4 off and so thought that we may as well pay. Pretty cowardly, but the council tax had gone DOWN and didn't want to keep getting asked about it, accruing interest etc so paid. It did take rather longer than we'd thought though.

So what can we expect to see for this road tax.Like some others in Ovacik,ours gets washed down the hill regularly,and to call it a road is like calling gordon brown a good prime minister!I dont mind dipping me and in me pocket,but a goat track is not a road,and knowing it will be dug up when they lay a main in ovacik( Apparently),is madness.Chocolate and fireguard have just leapt out at me....

Got asked for road tax when I went to pay council tax today, forgot all about the new tax and said I didn't have a car. A very nice turkish guy explained the situation - thank goodness. Cost @410TL for both.
Not bad ,but as I forgot, more than I had bargained for.This is for a three bedroom apartment. Roads around Tasyaka are not great, but I understand not the worst.
Still much cheaper than at home for a second home. Cheers Mary

Mary, you do not pay any tax in the UK for a second home, so its not cheaper, ask any of our MPs.

We paid our council tax today, half of the amount we paid last year. Harika!!
Got a bit concerned when we saw one Pelican at Calis end the other in Fethiye...can they possibly have been hit by their council tax bill (at least 2 years!!: :)) lol

Result!!! paid our council tax yesterday only increase approx 8TL, now 30TL and NO ROAD TAX!!!!!! Yippppeeeeee!

Result...paid our council tax yesterday...50% less than last year. We also paid road tax a very long time ago...we have got over it!! lol.

Went into Fethiye to pay Council Tax and Road Tax last week. Queued for over an hour and a half only to be told that for me there was no road tax this year. I suppose I should be grateful :D
