Title: help
Post by: mariem100 on November 19, 2011, 21:23:27 PM
Thank you for your comments. This is my situation.
I went on line and found a site called properties in Turkey. From that I arranged to meet the rep. in Oludeniz to view varios properties I had chosen. I met a guy called Ishmail who took me round looking at properties. He tried to push one in particular which was very nice but 20, 000 over my budget. The price dropped the next day by 10,000 £ and he knew perfectly well that my budget was 50,000 plus expenses. He took me to the Hanel offices in Fethiye and there it was agreed that I would pay £1000 deposit to hold the property a further £6000 at the end of November which would then be the 10% down payment paid. They then said that after the military check was satisfactory that I could pay the remaining £43,000. The remaining £10,00 I could pay over 10 months from the day of signing the contract. It says in the contract that I have that the tapu will be in my name on payment of £50,000 but that it will remain in the custody of the solicitor until the final £10,000 has been paid. In other words an interest free repayment of £10,000 over 10 months. They also reduced the fees ( tax, agency, lawyer) by about £1500
I visited  a lawyer recommended by them ( they said I could get my own if I prefered) and I felt that this solicitor came accross as being bone fide. Now that I have read your comments I have become very nervous about the whole thing.I have written to the Turkish board of trade to ask about the integrity of this company. What to do !!!!

Don't use their solicitor, better still use Scunner's agency, Assured Estates, to buy and then you will have no worries at all.

Sorry I couldn't possibly get involved with a deal involving another agent's customer. Good luck all the same.

I think the advice on this Forum has always been never pay a large sum up front, pay a small sum until you get your Tapu, then pay the rest of the money.   Lots of hard luck stories from people who pay the money and don't get a Tapu.
It's a pity you did not use Scunner from the start, then you would have had no worries.

Heather, Don't think it's who you buy from, I think it's the actual produce you buy at the end of the day.

Thank you again everyone ! I have just found out that the solicitor I am using is highly recommended by many people as being "excellent" so do I go ahead and buy from Hanel?

I do have to say that only you can answer that. Ozlen is the solicitor (not Ozgur) and as you say she comes highly recommended. By me too. If the property, contract and price feel right, it is normally right. If not, it most likely isn't - after years of discussions and debate, it all comes down to that. Nobody can answer that for you.

Mariem.
Do not under any circumstances pay the full ammount untill you get your Tapu. Argee to pay a deposit, then the rest of the money when your Tapu is in order. If they wont agree to this walk away. Meanwhile, look up other posts on the subject, on this and other fouums.

Hi. I have to go with the excellent advice from Kirkcaldy. If Hanel or any company you choose to do business with do not agree to this, walk away, there are many many properties out there that have all the paperwork in order!

Personally I would never use the same legal team as them, I've had first hand experience of just how helpful Hanels legal team were, and to be honest it's the only time in my life when I could of happily murdered someone!

Best of luck, whatever you decide
