FYI everyone, just listening the news and there is a new regulation coming to Turkey to protect the buyers of off plan property. from now on all the properties being sold should have insurance(in case they can not finish), construction permit and sales contract should be done at the notary and the contract should be registered to TAPU. also the builder should finish the property in maximum 36 months and minimum 5 years guarantee.
what was it before?
builder in most cases buys a land and directly goes to architect to have a model / 3d pictures of what he wants to build.
he sells the properties off plan and have a simple contract which is not really legally binding.
buyers pays a deposit and arrange stage payment.
when the builder decides to build he goes to belediye and apply for building permit(in most cases he gets it, but sometimes he has to make changes to apply with the regulations, and this would cause what you paid for and what you would get could be different)
this new regulations are not enough but definitely a good start. i will post here when i learn more about this new regulations.
