Problems with Turkish Estate Agency

We bought our villa off plan with Turkish Estate Agency (now operating out of reception of Poppy Apartments in Calis). We made final payment in June 2005 (our contract stated that upon last payment, and after correspondence with Aegean army, the tapu would be transfered into our names). In Dec 2006 we were advised to request tapu application No and date of application. The owner of the agency, Cem Cakir, could not present it after 3 weeks of phone calls, text messages and visits to his "office". Our solicitor investigated further and said that although he coudn't prove Cem had not sent for it, he could confirm that no record of any such application was at the deed office. I sent a letter of complaint to the ombudsman of Estate Agencies who spoke to Cem. They were told that he had lost the application No when he moved offices from Fethiye to Calis. Cem has said that he will re-apply if we pay another 1000 YTL for the new application. He has also refused to refund our original application fee.

With the help of Yetkin from Turkey Property Centre, we have now obtained our tapu.

Is this an isolated incident with Turkish Estate Agency?
Do you think this is acceptable?
Would you deal with Turkish Estate Agency?
