Hi

Does anyone know what the procedure is for making a claim via small claims court? I know it's £15 to lodge the claim, but not sure what to do after that.

Any advice/help gratefully received.

If you ring you local Citizen's Advise they will give you all the details you need.
They will tell you about the Small Claims Court, they will also give you information on trying a Solicitor's letter which will cost you a basic £30 and might do the trick without using the Small
Claims Court.

I did a claim a few years ago for criminal damage to one of my vehicles & it was easy.Got in touch with local county court & they sent out forms.Fill in forms with relevant info,bills,estimates etc & send fee.Wait for reply from court with court date then go infront of judge who may ask you & defendant questions then the judge sends you out of court to make decision then calls you back into court, in my case within 5 minutes & case proved so order was made for defendant to pay weekly.Defendant is liable for costs if you win.If they do not pay you go back to court & they then send bailifs & those charges are added to costs.

You can do it all on line. Took Aegean to court that way a couple of years ago as I was getting the runaround for a refund on a flight they cancelled. They coughed up virtually immediately and paid all the costs as well

Depends where you live the law in Scotland is different from English law.

It is a really straight forward process but if it goes to court be aware that those who are defending themselves can ask for it to be heard in a court closest to them so you may have to travel, also if it goes to court they like to see that you have followed the necessary steps to settle your claim amicably and that you have plenty of documentary evidence of letters etc sent to the other party.

I bought a 20kg box of scallops which were tiny, I took legal action against the fishmonger and won.
