I'm not sure I can agree with that - you should pursue builders who don't meet their financial obligations and then pursue the money using all legal means and a good lawyer like Sule or Ozlen. That is why the law exists and it is no different in the UK that you may have a lengthy legal case then still have to pursue the guilty party for the money - but we don't advise people in the UK to forget it.

One of the most irritating things about running this forum and being involved in the property business is knowing better than most what underhand tricks go on (and where, and by who) and then when a potential new buyer comes on here to ask what a developer is like, all the affected owners don't say a word.

The court fee was 50tl about 3 months ago, when we had to take a neighbour to court for non payment of maintenance + the solicitor will take 25% of whatever is awarded, which are set charges

Seems like an appropriate opportunity to chip in with a contribution as we have recently had experience of Infinity/Deska and their lying, cheating, and prevaracating tactics.  We have investigated the legal route and, on balance, feel we will not pursue it for the reasons mentioned in recent posts, i.e. the high cost of pursuing the claim against the far from certain chance of a successful outcome.
We bought a villa from Infinity and, to cut a long story short, they ran up a very large bill for water through building an adjacent property, and for 5 years they said verbally and in writing that they would pay for the water that they had used (we continued to pay for our own water consumption).
Prior to selling our villa recently, we tried everything to get them to meet their previously stated obligation, but surprise, surprise, they never did!  We had to pay approx 1700 TL - most of which was penalty payments which had accrued due to their non payment of the original Infinity water bill.  We had no choice but to pay as the property had to be debt free in order for the Transfer of Title to take place.
Lesson to be learned here - DO NOT TRUST DESKA/INFINITY THEY ARE CHEATS, LIARS AND THIEVES!
Having been priced out of legal recourse, we will now seek to give Infinity as much grief as possible by warning other people not to trust them or buy from them.
As per Scunner's comment, we have no qualms about telling the truth on CBF about this dispicable property devloper.
