We have a top floor apartment in a block of 3. What we need to know is who is responsible for the roof if anything goes wrong with it.  As far as we know there is no maintenance agreement between apartments.

I would be very surprised if there was not a shared responsibility on the major structural item such as this, if a leaking room causes problems it could affect the whole block! I would suggest that you have a word with either the developer or the company/person you purchased through. If that fails, if you e-mail me, I will suggest the Company I used to purchase my place and whom I trust totally. They also have English speaking staff and would be able to offer advice.

My understanding is that if there is no overriding condominium agreement that states anything otherwise, you are responsible for the roof. This follows the same logic and law that causes any rising damp at the ground floor to be not your concern. I must say that this topic has been debated on a number of occasions on here and there are several opinions that differ from my own - I do strongly believe I am right though  ;)

I would bow to Scunner's experience on this topic such is his knowledge of Turkey and of the property market generally, with luck, I might be right and him wrong but I doubt it. Would there be any value in seeking a legal opinion as I am surprised that there is an absence of a shared legal agreement on such matters.

There is of course the option to speak to your neighbours below and gauge what their feelings are - I have known complexes where everyone has taken responsibility for roof repairs.

We had a big problem with the roof in our previous apartment and were advised by our lawyer that it was a communal responsibility, therefore a cost to be shared by all of the owners.

We are in a complex on the upper floor so far we have paid out twice ourselves for repairs to our part of the roof a total £1000 I know other owners in our complex have paid out simular costs. I thought it was everyones responsibilty to share that cost.I would be interested if anyone can shed some light on this as it seems unfair that those who own apartments on the upper floor of a complex are expected to footing the bill when there is a problem with the roof.
We always contribute to any problems that arise such as drainage or other ground floor maintenance.

My friend has an answer for the question as to who the roof belongs too. She said if it is just my roof then take your tv ariels and hot water tanks off it.!! Our insurance company says we are all responsible and have all taken out buildings insurance to cover storm damage. However we are on the ground floor. I doubt very much that anyone would want to contribute if we had damp which luckily we dont.

Don,t know if this helps or not?

I have a property in Uzumlu (insured with Intasure)
The dwelling was constructed as a 4 bed property which was divided into 2 seperate 2 bed apartments. (sharing the same grounds, pool drives etc..
(Obviously covered by the one roof)
Recent roof repair claim considered to be joint responsibility.
Repairs carried out but 2 excess payments taken.
