INFO PLEASE..ASAP !!!
« on: February 10, 2011, 09:41:17 AM »
Good Morning to all...
I really need some help right now... a friend of mine just came to me with a problem and i want to see if I can help with getting the info they need..
their place (home) was built and an extention was put on the roof and no paper work was done... cause the builder said " you didnt need it that if you were caught all you have to do is pay a fine and that was that" . as so... they went to the belediye payed the fine and all was done.
now that someone has complained to ankara about the roof is not regulation and now he was told that he has 10 days to pull it down.. the roof has been up for 5 years now and only the british people are being targeted (as it appears) in the area in koca calis and it is to be the builder that is doing this.
the question at hand is... isnt there a law out there about there about the time for take down... we are hearing that it is not a "10 day pull down" that it is about 3 month warning.
i have looked all over at the laws and i cant find the law on it. i think im looking in the wrong places.
does anybody out there have any info on this matter !!!
true no paper work...
payed the fine.... last year...november...
have prof on paying the fine about the roof...
have pictures showing the roof is "not" above others on the complex..
others on the complex are higher.. so it meets standerds...

what could be done  and what is the time line about geting it pulled down... again we know it is not 10 days.

thanks all... sorry for the spelling.. trying fast to get this done.
thanks for you halp... please get back to me...ASAP !!!!

Call me a cynic...but a letter from Ankara sounds a bit grand for a planning/building problem - I would have expected one from the local belediye.
Are they sure it is a genuine letter & not one generated by this dubious sounding builder to generate more work?
I would have thought if they have paid their fine & have a receipt then a trip to the planning department should sort it.

Wishing them good luck!

Pam your friend MUST get a solicitor's advice - local and national regulations and laws are too much for people like us to fathom. I'd recommend Ozlen Ozergin for all property matters. She will make sense of it all and it really will be money well spent. If you ask 10 people on here or locally there, you will get ten different answers. You need a full and final answer for this so your friends can draw a line under the whole matter and get on with their lives.

Agree about the solicitor but not about only being British people being affected.
I know of several Turkish people who have had to demolish properties too, usually smaller buildings in their garden which they have built as added accommodation or work facilities. These were in Ovacik.
