I have a small apartment in Calis. It is one of 8 around a pool. 5 are owned by Brits and
the Builder / Maintenance guy has one and his two brothers own the other two.
He claims all owners pay £350 in January. I ask for a legal maintenance contract and accounts when I brought my apartment 2 years ago but he has refused to provide any documentation at all. I have always been concerned that not every Owner was paying their fair share of the
maintenance and paid some funds into his account while waiting for legal documentation.
In August of last year I started to pay 300tl per month by direct debit into his account.
In May this year he cancelled his account with the same bank as mine without letting me know. He now claims that I am in arrears and although I have requested details of his new Bank so that I can bring the DD account up todate, he is not willing to provide the information.
Last Friday my new tenant moved in and today he has emptied the pool and will not refill until September when one of the Brits arrives on holiday. If as he claims that he and his 2 brothers who live on the site and have all paid their £350 fees.  He has emptied the pool because of a dispute with me over his inability to conform with Turkish Condominium Law so my new Tenant is being penalized. As I am currently in the UK I am unable to find the best solution and would appreciate any practical suggestions please.

Roy, either I am totally misreading this or your maths do not add up.300TL is about £115 and you are paying this every month.You have paid him in excess of £1,000 and I do not understand how that ties up with paying £350 a year. You have paid him 3 times that amount.

If I have misunderstood I apologise.

Also we have been told that a pool should not be fully emptied, it should be left half full in case of earth tremors which can damage the side of the pool if it's empty.  If it does get damaged, make it clear, he is responsible.

Everyone used to say dont empty the pool for two main reasons.

1/ People (especially kids) may fall into the empty pool.
2/ It was badly built and leaked a lot when it was in use. This means that when empty, the water vin the surounding earth is very heavy and often causes it to collaps.

The main problem is that when you leave the pool full it will go green or black is not looked after, most people don't want the expense during the winter.

Being a Hotel Engineer we sometimes emptied it but put fencing around it, or leave if full but continue to maintain

We have been told by Engin of Fethiye Property Services, who look after our property, they always leave the pools half full, including ours because of earthquakes.  We obviously, know nothing of earthquakes, but assume he knows what he is talking about ;)

All the owners do pay the maintenance fee in a lump sum.  Payment is made every January (as you have been made aware in the past).  It has always been done this way since we first bought the apartment 7 years ago.  We have never had any trouble with the pool or the gardens.  I understand the pool is half empty/full from what we have been told. This is the first time this has occurred.

It would be best if this could be resolved asap without involving other people.

About 3 years ago at the suggestion of the current maintenance person, we made independent enquiries about changing maintenance contracts and obtained quotes from other property/pool maintenance/garden companies. They were all more expensive than the current maintenance person plus extra charges were added on too.

Do you really belive that having a pool half full would protect it against an earthquake, and if so what do you do with your house. Fill it with water.

Have you tried Engin for a quote for maintenance? We now use him and find him reasonally priced and reliable
