building work fine
« on: August 27, 2016, 08:26:31 AM »
Along with about 40 others on Telemossos complex we have received a fine from Fethiye council for some building work we have had done to our patio (we have squared it off rather than the scolloped shape it was apparently taking some common ground). We have joint names on our tapu and have received a fine EACH the same amount on each fine with 2 different fine numbers on them, the fine is in 2 parts we have one now and another to follow in 30 days. We are questioning the 2 fines to one property? has anyone else had experience of such things?
We went to the council to sort it out the person we needed to speak to wont be there until Monday (nothing is that simple is it!).
We have spoken to one Turkish friend who said dont pay it, but we wont be here to defend ourselves in 30 days time so need to sort it out this week.
Some property owners have already paid theirs, there are more still to be fined but everyone we have spoken to no little about the law/rules regards this and all have one name on their tapu.
Any knowledge would be helpful please

The advice is pay the fine...how much is it? Taking extra land however small is taken seriously- especially when someone reports it which is normally the case.

Lots of fines/taxes etc are sent to each named owner rather than each property/Tapu.

If you go home and ignore this it will be a nagging pain for you and I doubt it will go away.

In fact, it might be subject to interest which snowballs and can come back and bite you years later -  maybe even in the day in 20 years when you sell it for example.

I'd get it put to bed. Good luck.

Does paying the fine then cancel the reason for it. eg you are been fined for taking a bit of land. If you pay the fine does that make it acceptable or will it crop up again in the future?

Having been involved (as in our co-op) in a long and drawn out dispute with Fethiye belediye over a few square metres of land before, I would get some advice over this one.

The fine is just that, it's not permission to use or take possession of the land - no matter how miniscule it is.  It may be a good idea to get together and appoint one person to liaise with the council, especially as there are quite a few owners involved. Maybe someone like Sule...?

Our issue took seventeen years to resolve, hence we could only issue tapus a couple of years ago.

We do intend to pay the fine but I have no idea if that will be the end of it, its aprox 2k in total. And yes keith it was one of the other owners on the site who reported everyones building work even though he has had the same work done and been fined himself (no back hander there then!).
One owner a turkish solicitor looked at it on behalf of a few owners but I have been told he has now paid his and is thinking about selling his?.
I wouldn't mind but we only had it done because our balcony roof fell down over the winter and needed replacing so had the patio done at the same time in line with other owners because ours looked a bit out of date!
